The former chief executive of Volkswagen AG, Martin Winterkorn, has appeared in a German court ahead of his trial for charges related to the infamous dieselgate scandal. The scandal, which rocked the automotive industry in September 2015, involved Volkswagen’s use of illegal software to cheat diesel emissions tests.

Winterkorn, who is now 77 years old, had requested a postponement of his trial due to health issues. However, the judge rejected his plea, and the trial is proceeding. Winterkorn is facing charges of fraud, market manipulation, and unlawful false testimony before a parliamentary committee. He maintains his innocence and denies all charges.

Prosecutors’ Allegations

Prosecutors allege that Winterkorn had knowledge of Volkswagen’s use of illegal software to cheat emissions tests. The software could detect when a vehicle was being tested and manipulate the emissions controls to meet regulations. Outside of testing, the vehicles emitted toxic nitrogen oxides into the air.

Winterkorn is also accused of authorizing a recall of affected vehicles in 2014 to prevent regulators from discovering the software. A charge of market manipulation alleges that Winterkorn failed to inform VW shareholders in a timely manner about the financial risks associated with the software.

Lengthy Trial Expected

Winterkorn’s trial has been postponed multiple times due to his health issues. Approximately 90 days have been scheduled for testimony in the case, and it is expected to last until September 2025. It is not uncommon for criminal trials in Germany to last for years. Four other VW executives have been on trial for their involvement in the dieselgate scandal since 2021.

Potential Consequences

If convicted, Winterkorn could face a maximum sentence of 10 years in prison. However, it is unlikely that he will receive such a lengthy term. Last year, the former boss of Audi, Rupert Stadler, received a suspended sentence after pleading guilty to his involvement in the dieselgate scheme.
